This page is maintained by AtTheGate International Auctions Ltd to set out the rules for using the AtTheGate marketplace. It is not legal advice; you should have your attorney review these terms before advertising the site publicly.

1. Acceptance of terms

By accessing or using AtTheGate (the “Site”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for users who are at least 18 years old and legally able to enter into binding contracts. By using the Site, you represent that you meet these requirements. AtTheGate reserves the right to suspend or terminate accounts that appear to be used by minors or in violation of these terms.

3. Accounts and registration

To list, bid, or buy, you must register for an account and keep your login credentials secure. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized use.

4. Listings and seller obligations

Sellers are responsible for the accuracy of all listing information, including but not limited to pedigree, photos, videos, age, location, and seller contact details. Listings must describe the actual horse being offered and must comply with all applicable laws and industry regulations. AtTheGate reserves the right to remove or edit listings that are inaccurate, misleading, or violate platform rules.

5. Bidding and buying

All bids placed on the Site are binding. By placing a bid, you commit to purchase the horse if you are the winning bidder. Bid increments, auction timing, and soft-close rules are described in our Auction Rules. Failure to complete a winning transaction may result in forfeiture of AtTheGate privileges and other remedies.

6. Fees and payments

Listing fees, commissions, and other charges are described on the Site and are subject to change. Payments are processed through Stripe. By listing or purchasing, you authorize us to charge applicable fees and to collect commissions on completed sales. All fees are non-refundable unless otherwise stated.

7. Prohibited conduct

You may not use the Site to:

  • Post false, misleading, or fraudulent listings.
  • Bid with no intention to purchase or manipulate auction outcomes.
  • Harass, abuse, or misrepresent yourself to other users.
  • Circumvent platform fees or contact-reveal processes.
  • Upload viruses, malware, or other harmful code.
  • Violate any applicable law or regulation.

8. Transactions between users

AtTheGate provides a marketplace for buyers and sellers to connect. We are not a party to the sale of any horse. Buyers and sellers are responsible for completing their own transaction, including payment, transfer of title, registration papers, insurance, shipping, and veterinary arrangements. AtTheGate facilitates introductions and payment of platform fees, but does not guarantee the condition, health, or performance of any horse listed.

9. Intellectual property

All content on the Site, including text, graphics, logos, and software, is owned by AtTheGate or its licensors and is protected by copyright, trademark, and other laws. Users may not copy, modify, distribute, or create derivative works without permission. By uploading listing content, you grant AtTheGate a license to display that content on the Site and in promotional materials.

10. Disclaimers

The Site is provided on an “as is” and “as available” basis. AtTheGate makes no warranties, express or implied, regarding the accuracy of listings, the availability of the platform, or the outcome of any auction. Users rely on listing information at their own risk and should conduct their own due diligence before bidding or buying.

11. Limitation of liability

To the fullest extent permitted by law, AtTheGate and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any transaction between users. Our total liability is limited to the amount of fees actually paid by you to AtTheGate in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless AtTheGate, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Site, your listings, your bids, or your violation of these terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which AtTheGate International Auctions Ltd is organized, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the courts located in that jurisdiction.

14. Changes to these terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes means you accept the updated terms.

15. Termination

AtTheGate may suspend or terminate your account and access to the Site at any time, with or without notice, for conduct that violates these terms or that we believe is harmful to the platform or other users.
